Terms of Service

1. Agreement

By creating an account or using Skieztheday, you agree to these Terms. If you do not agree, do not use the service.

2. Who may use Skieztheday

• You must be at least 18 years old.
• Skieztheday is offered to residents of the United States. We do not direct it to any other country.
• We do not knowingly collect personal information from children under 13. If you believe a child under 13 has an account, contact us and we will delete it.
• You are responsible for your account credentials and for activity under your account. Tell us promptly if you believe your account has been used without permission.

3. What Skieztheday is

Skieztheday helps you choose where and when to ski. It shows resort conditions scores, typical snow depth for your dates from measured station history, cited seasonal outlooks, and estimated flight and lodging costs from your home airport. It links you to other sites to book.

4. Fees

Skieztheday is free today. We collect no payment information. If we offer a paid pass, its price and terms will be shown before you buy, and these Terms will be updated first.

5. Plans and limits

A free account may hold up to three active plans, each with up to three candidate resorts. Plans for trips that have ended are archived automatically. We may change these limits; the current limits are shown in the product.

6. Conditions, scores and typical snow are informational

• Snow, weather and outlook figures come from public data sources and forecast products. They can be late, incomplete or wrong.
• Scores are our own calculation from that data. A score is not a forecast and not a promise of conditions.
• Typical snow depth is a historical median from a named measuring station. It describes past winters, not the winter you will ski.
• Seasonal outlooks are shown as published by their source, with the source named. We do not make our own long-range predictions.

7. Prices are estimates

Flight and lodging figures come from third-party price data. They can be stale, marked as estimated, or unavailable. The price on the booking site is the real price.

8. Booking happens on other sites

Booking links take you to airline, lodging or travel sites. Any booking you make is between you and that site, under its terms. We are not a travel agent and do not sell travel.

9. Mountain travel carries risk

Skiing and mountain travel carry risk. Weather, road closures, lift operations and avalanche danger can change quickly. Skieztheday does not assess safety. Check the resort, road authorities and avalanche centers before and during your trip. You are responsible for your decisions to travel and to ski.

10. Your content

"Your Content" is what you enter: your profile, your plans, saved trips and anything you send us.

• You own Your Content.
• You give Thresh Lab a non-exclusive, worldwide, royalty-free licence to store, process and display Your Content to operate the service for you, including sending the relevant parts of it to the service providers named in our Privacy Policy.

11. Acceptable use

You will not:

• use Skieztheday for anything unlawful, or to harm, harass or deceive anyone;
• attempt to access accounts or data you are not authorised to access, or test our security without written permission;
• interfere with the service, including by automated traffic, scraping or excessive requests;
• copy, resell or redistribute the service, its scores or its data at scale, or use them to build a competing service;
• misrepresent who you are or your relationship to Thresh Lab.

12. Accounts, suspension and termination

You may stop using Skieztheday at any time and may ask us to delete your account by emailing support@skieztheday.com from your account email.

We may suspend an account we reasonably believe breaches these Terms or creates risk for other users. Where practical we will tell you why and give you a chance to respond. We may terminate an account for material breach, and may discontinue the service on reasonable notice.

13. Intellectual property

Thresh Lab and its licensors own Skieztheday, its software, design, text, scores, marks and structure. These Terms give you a limited, revocable, non-transferable right to use the service for its intended purpose. No other rights are granted.

14. Third-party services

Skieztheday relies on third-party services for hosting, authentication, email, price data and public weather and snow data. The ones that receive your information are named in our Privacy Policy. We do not control them and are not responsible for their availability or their terms.

15. Disclaimer of warranties

Skieztheday is provided "as is" and "as available". To the fullest extent permitted by law, Thresh Lab disclaims all warranties, express or implied, including merchantability, fitness for a particular purpose, accuracy and non-infringement. We do not warrant that the service will be uninterrupted, error-free or secure, or that any figure it shows will be accurate.

16. Limitation of liability

To the fullest extent permitted by law:

• Thresh Lab is not liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, data or goodwill, arising from your use of Skieztheday, including travel you book or take based on it.
• Thresh Lab's total liability for all claims relating to Skieztheday in any twelve-month period is limited to one hundred US dollars ($100).

Some jurisdictions do not allow certain limitations; in those places our liability is limited to the smallest amount the law allows.

17. Indemnity

You will defend and hold harmless Thresh Lab and Douglas Styler from claims, losses and reasonable costs arising from Your Content, your breach of these Terms, or your unlawful use of the service.

18. Changes

We may change Skieztheday at any time. We may change these Terms by posting a new version with a new effective date. For material changes we will notify you in the product or by email at least fourteen (14) days before they take effect. Continued use after the effective date is acceptance. Previous versions are available on request.

19. Governing law and disputes

These Terms are governed by the laws of the State of Tennessee, without regard to conflict-of-law rules. Any dispute will be brought in the state or federal courts located in Williamson County, Tennessee, and you consent to their jurisdiction. Before filing, both sides agree to try to resolve the dispute by written notice and good-faith discussion for thirty (30) days.

20. General

If any part of these Terms is unenforceable, the rest remains in effect. These Terms and the Privacy Policy are the whole agreement between you and Thresh Lab about Skieztheday. You may not assign these Terms; we may assign them to a successor of the business or the product. Failure to enforce a term is not a waiver.
